1. Acceptance of Terms

By accessing or using the website at eaglepassinsulation.com or by engaging Eagle Pass Insulation for any service, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services. These terms apply to all visitors, customers, and others who access the site or receive services from us.

2. Description of Services

Eagle Pass Insulation provides residential and commercial insulation services in Eagle Pass, TX and surrounding communities. Services include but are not limited to spray foam insulation, attic insulation, blown-in insulation, crawl space insulation, wall insulation, air sealing, vapor barrier installation, insulation removal, and related work. All services are performed by our team or approved subcontractors and are subject to a written service agreement or estimate prior to commencement.

3. Estimates and Pricing

Free on-site estimates are available and are provided in writing before any work begins. Estimates are based on information available at the time of the assessment. Final pricing may be adjusted if:

• Conditions discovered during work differ materially from those observed at the estimate visit (for example, hidden damage, unforeseen access limitations, or pre-existing structural issues)
• The customer requests additional work or materials beyond the original scope
• Material prices change significantly between the estimate date and the scheduled work date due to factors outside our control

Any changes to the original estimate will be communicated to the customer in writing and require customer approval before additional work is performed. We do not charge for standard estimate visits.

4. Scheduling and Cancellation

Appointments are scheduled by mutual agreement between Eagle Pass Insulation and the customer. We ask for reasonable advance notice if you need to reschedule or cancel:

• Cancellations or reschedules made at least 48 hours before the appointment will incur no charge.
• Cancellations made with less than 48 hours notice may be subject to a scheduling fee, which will be communicated at the time of booking.
• We reserve the right to reschedule appointments due to weather conditions, equipment issues, or other circumstances beyond our control. We will provide notice as soon as possible and work with you to find the next available time.

5. Payment Terms

Payment is due upon completion of each job unless a separate written payment schedule has been agreed to in advance. We accept cash, check, and major credit cards. For larger projects, we may require a deposit prior to scheduling work. Deposit terms will be stated clearly in the written estimate or service agreement. Invoices not paid within 30 days of the due date may be subject to a late fee of up to 1.5 percent per month on the outstanding balance. Customers are responsible for any collection costs, including reasonable legal fees, incurred to recover unpaid amounts.

6. Customer Responsibilities

To allow us to complete work safely and efficiently, customers are expected to:

• Provide clear access to the work area, including removing stored items and ensuring attic hatches, crawl space entries, and other access points are unobstructed
• Vacate the premises (along with all occupants and pets) during spray foam installation and for the re-entry period specified by our crew
• Disclose any known pre-existing conditions - including water damage, mold, pest infestations, or structural concerns - prior to work beginning
• Ensure utilities (electricity and, where needed, water) are available at the property on the scheduled work day

Eagle Pass Insulation is not liable for delays or additional costs resulting from undisclosed conditions or a customer's failure to prepare the work area as requested.

7. Warranty

We stand behind the quality of our work. If a defect in workmanship is identified within one year of project completion, we will return to assess and correct the issue at no charge, provided the defect is not caused by subsequent damage, misuse, or conditions outside the scope of our original work. Material warranties, if any, are governed by the manufacturer and will be communicated in your written estimate. This warranty does not cover normal wear and tear, damage caused by water intrusion from pre-existing building defects, pest damage, or structural movement.

8. Limitation of Liability

To the fullest extent permitted by law, Eagle Pass Insulation shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to services performed or this website's use. Our total liability to any customer for any claim shall not exceed the total amount paid by that customer for the specific services in question. We are not responsible for losses, costs, or damages arising from circumstances beyond our reasonable control, including acts of nature, utility outages, or pre-existing property conditions not disclosed to us prior to work.

9. Website Use

The content on our website - including text, images, and other materials - is provided for general informational purposes. We make no representations or warranties as to the accuracy or completeness of any information on the site. We reserve the right to modify or remove content at any time without notice. You may not copy, reproduce, or republish our website content without written permission.

10. Dispute Resolution

We prefer to resolve any concerns directly. If you have a complaint about our work or a billing disagreement, please contact us first and we will work in good faith to find a resolution. If a dispute cannot be resolved informally, the parties agree to attempt mediation before pursuing litigation. Any legal proceedings shall take place in Maverick County, TX.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Maverick County, Texas.

12. Modifications to These Terms

We reserve the right to update these Terms and Conditions at any time. When we do, we will update the effective date at the top of this page. Continued use of our website or services after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
